Will AI Transform Mediation in the Digital Age?


All human societies carry within them the traditions of dispute resolution and mediation, from Ho'oponopono the ancient Hawaiian practice for reconciliation, forgiveness, and making things right to restore balance, to the pre-Islamic tribal customs, formalised by Islamic Law into sulh (amicable settlement) and Al Wasata (independent mediation) to resolve disputes through consensus. At EQ8 Mediation we felt ourselves to be on the cutting edge of utilising the internet in mediation, through our virtual mediation services, liberating mediation from the necessity to be face to face in a physical environment. Now, however, with the alacrity with which Artificial Intelligence has grown and the breadth of its applications, we must consider; can AI mediate?


As artificial Intelligence is revolutionising our world, its application in dispute resolution is no exception, but as yet, underexplored.  As virtual mediation is being increasingly utilised, it makes dispute resolution more accessible and cost effective, but AI brings with it the possibility of adding efficiencies and being data driven.  


The use of AI to resolve disputes has in fact been in place for some time; consider the millions of consumer disputes handles annually, by the algorithms of companies like eBay and Amazon. The power of the machine learning, can process claims around the clock without human intervention and deliver consistent outcomes based on established patterns.

Where professional mediators can utilise AI is the preparation of a mediation, such as familiarising themselves with relevant history or precedent, and clarifying key issues.  As well Ai can assist professional mediators in analysing case documentation, ultimately relieving us of time-consuming paperwork in order to focus on the human elements of dispute resolution.


One novel way of using AI in mediation can be to harness its predictive analytics, to forecast likely settlement ranges based on historical data. This helps parties set realistic expectations to guide them in probable outcomes. AI is not however a definitive answer, and does not remove that organic, creative dimension of the mediation process.

One of the key benefits of mediation is its cost-effectiveness when compared to formalised, legal dispute resolution. Just as virtual mediation has helped to amplify the accessibility of mediation, by breaking down geographical and financial barriers, AI can be used to bring the transformative benefits of mediation to more people and organisations, in an increasingly cost and time effective manner.


The success of mediation relies intrinsically upon the impartial and objective mediator. AI algorithms can enhance the fairness and consistency of mediation by applying consistency in case handling. This helps to reduce unconscious bias, though human oversight- and insight- remains essential to ensure contextual understanding.

Mediation fundamentally relies on empathy, emotional intelligence, and nuanced communication – qualities that AI cannot fully replicate. The ability to read body language, understand cultural contexts, and build trust remains uniquely human. As well AI- whether as a Large Language Model, or Neural Networks- relies on data being fed into the machine; a fundamental part of the mediation process however is not on what is being said, but being sensitive to what is not being expressed and being able to be quiet, present and ‘hold’ the stillness that facilitates the transformation process.


The future of AI in mediation isn't about replacement but augmentation and insightful utilisation. Ai in mediation has some potential benefits such as increased access to justice, improved efficiency, and data-driven insights. The key to implementing AI in the mediation is to do so consciously and thoughtfully, enhancing the human -centred practice by leveraging technological innovation, whilst never losing our focus on preserving mediation's core values. As we move forward, the most successful mediation practices will be those that skillfully blend artificial intelligence with authentic human connection.
